§ 1 Scope & Conclusion of Contract
1.1 These Terms and Conditions apply to all sessions and services provided by Ecstasy Dark (hereinafter “the Service Provider”).
1.2 Prior to the conclusion of a contract, the Service Provider will communicate the tribute amount and any applicable deposit to the guest individually. The guest expressly confirms these terms before making a booking.
1.3 A binding contract is concluded only upon written booking confirmation by the Service Provider – and only after tribute and deposit have been agreed upon by both parties in advance.
1.4 By making a booking, the guest confirms having read, understood and accepted these Terms and Conditions.
§ 2 Minimum Age
2.1 Sessions are conducted exclusively with adults aged 18 and over. Persons under the age of 18 will be refused without exception.
2.2 the Service Provider reserves the right to request proof of age.
§ 3 Scope of Services & Session Locations
3.1 Sessions take place at the Fetisch Institut Berlin and have a minimum duration of 1 hour.
3.2 Hotel sessions are available for a minimum of 2 hours.
3.3 Club performances are available for a minimum of 3 hours and require prior arrangement.
3.4 The services offered exclusively comprise BDSM and fetish practices within the context of professional dominance. Sexual acts within the meaning of the German Prostitution Protection Act (ProstSchG) are expressly not part of the offering and will not be performed.
3.5 Spontaneous appointments are available subject to availability. Advance booking of at least 24 hours is recommended.
3.6 Sessions are open to all people regardless of gender, sexual orientation or physical ability. Queer individuals, couples and people with disabilities are warmly welcome.
$ 4 Tribute and Payment
4.1 The tribute for a session is agreed individually between the Service Provider and the guest prior to the conclusion of the contract and forms part of the pre-contractual arrangement.
4.2 The tribute varies depending on the type, duration and location of the session as well as any additional services requested.
4.3 The full tribute is to be paid in cash before the session begins, unless an alternative payment method has been agreed. The deposit (§5) will be deducted from the total amount.
§ 5 Deposit
5.1 The deposit amount is agreed individually prior to the conclusion of the contract and forms part of the pre-contractual arrangement. It may vary depending on the type, duration and nature of the booking.
5.2 The deposit may be paid by bank transfer, PayPal or cash (placed in an envelope and deposited in the studio letterbox).
5.3 The deposit will be deducted from the total tribute and is generally non-refundable, except as provided in §6.
§ 6 Cancellation & Rescheduling
6.1 Cancellation by the guest:
– Cancellation more than 48 hours before the appointment: The deposit will be credited towards a future session and remains valid for 60 days.
– Cancellation less than 48 hours before the appointment: The deposit is forfeited. No complimentary replacement appointment will be offered. Cancellation costs amount to 100% of the agreed tribute.
– No-show (failure to appear without notice): The deposit is forfeited in full. No entitlement to a replacement appointment exists.
6.2 Rescheduling by the guest:
– Rescheduling more than 48 hours before the appointment with simultaneous notification of a new date: The deposit will be transferred to the new appointment and remains valid for 60 days.
6.3 Cancellation by the Service Provider:
– the Service Provider reserves the right to cancel a confirmed appointment for good cause (e.g. illness, emergency).
– In such cases, the deposit will be refunded in full or, at the guest’s request, transferred to a new appointment.
– Further claims by the guest, in particular for damages, are excluded.
6.4 the Service Provider reserves the right to refuse or terminate a session at any time without giving reasons, in particular in the event of a breach of these Terms and Conditions or inappropriate behaviour. In such cases, no refund of tribute will be due.
$ 7 Health & Safety
7.1 The guest is obliged to disclose all relevant health conditions, illnesses or injuries prior to the session that may be relevant to its conduct.
7.2 Practices that endanger health are not permitted.
7.3 The use of equipment and furniture is at the guest’s own risk and responsibility.
7.4 the Service Provider accepts no liability for health-related or other damages arising from the use of the facilities, unless caused by gross negligence or wilful misconduct on the part of the Service Provider.
$ 8 Photography & Video Recordings
8.1 Photography and video recordings during a session are strictly prohibited and permitted only with the Service Provider’s express prior consent.
8.2 the Service Provider guarantees complete discretion on her part. No recordings of guests will be made or published without their explicit consent.
§ 9 Discretion & Data Protection
9.1 Both parties undertake to maintain mutual discretion. Information about the other party, the content of the session and personal data will be treated as confidential and not disclosed to third parties.
9.2 The processing of personal data is carried out in accordance with the Privacy Policy.
§ 10 Liability & House Rules
10.1 the Service Provider accepts no liability for clothing or personal belongings brought by the guest.
10.2 In the event of damage to the facilities or equipment caused by gross negligence or wilful misconduct, the party responsible shall be fully liable.
10.3 the Service Provider exercises the right of domicile. She is entitled to remove persons who violate these Terms and Conditions or behave inappropriately from the premises.
§ 11 Final Provisions
11.1 The law of the Federal Republic of Germany applies. Place of jurisdiction is Berlin.
11.2 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
11.3 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
